Terms of Service

These Terms govern the use of Geovium, a service that measures how AI assistants mention your brand. Please read them together with our Privacy Policy.

1. Parties and acceptance

These Terms are an agreement between KUTBU YAZILIM BİLİŞİM TEKNOLOJİLERİ SANAYİ VE TİCARET A.Ş. (“Geovium”, “we”, “us”) and the organization that creates an account (the “Customer”), together with each person who uses the account (a “User”).

By creating an account or using the service, you accept these Terms. If you accept them for an organization, you confirm that you are authorized to bind it. If you do not accept them, do not use Geovium.

You must be at least 18 years old and able to enter into contracts. Geovium is intended for business use.

2. The service

Geovium sends the questions you define to third-party AI assistants, currently ChatGPT (OpenAI), Gemini (Google), Claude (Anthropic), Perplexity and Grok (xAI), through their APIs. It stores the answers and measures whether and how your brand and your competitors are mentioned, and turns the results into scores, reports and suggested tasks. It can also read data from integrations you connect (Google Merchant Center, Google Business Profile, Shopify).

Features, supported assistants and models can change over time; we may add, change or remove them.

3. AI answers and results: what we do not guarantee

  • Results depend on third-party assistants. Their answers change with the model version, web search, location, language and time, and answers received through an API can differ from what people see in the consumer apps.
  • AI answers can be inaccurate, incomplete, outdated or biased. Geovium records and analyzes them; it does not verify or endorse them.
  • Scores and reports are estimates produced by our methodology from a sample of answers. They are not a measure of rankings, traffic or sales.
  • We do not guarantee any ranking, mention, visibility, traffic or business result, nor that following the suggested tasks will change what assistants say.
  • An assistant can become unavailable, restrict access or change its terms. Scans for that assistant can then fail or stop.

4. Accounts, organizations and roles

Every account belongs to an organization, and the person who creates it is the owner. The owner and the organization admins manage members, roles, billing, email preferences and data exports. Workspace roles (for example admin, analyst or viewer) decide who can change settings and who can only view results.

  • Give accurate information and keep it up to date, including the invoice details.
  • Keep your password confidential; we recommend turning on two-factor authentication.
  • Tell us promptly if you notice unauthorized access.
  • The Customer is responsible for the activity of its Users and for the people it invites.

5. Acceptable use

You must not:

  • break the law or the rights of others, including intellectual property, privacy and data protection rights;
  • put special categories of personal data, confidential information of third parties or unlawful content into questions or settings;
  • use Geovium in breach of the usage policies of the AI assistants it queries, or to produce spam or misleading content;
  • try to gain unauthorized access, test or bypass security, quotas or spend limits, or disrupt the service;
  • scrape, copy, reverse engineer or resell the service, or use it to build a competing product, except as the law expressly allows;
  • share your account or sign-in details with people outside your organization.

We may suspend access that breaches this section (see section 16).

6. Free trial

A new organization starts with a free trial. Its length and what it includes are shown on the pricing page (currently 14 days, with no payment card needed). When the trial ends, you need a paid plan to keep using the workspaces and running scans. Your data stays in the account until you delete it (see section 16).

7. Subscription, billing and renewal

  • Plans, prices, included usage and add-ons are shown on the pricing page and in the application before you buy. These Terms do not repeat prices.
  • Subscriptions are paid in advance, monthly or yearly, by card through Stripe. You must complete the organization's invoice details before starting a paid plan.
  • A subscription renews automatically at the end of each billing period for the same length of time until it is cancelled, and the renewal is charged to the saved payment method.
  • Upgrades and add-ons can be invoiced immediately, prorated for the rest of the current period.
  • Any taxes that apply are shown on the invoice.
  • If a renewal payment fails, access continues for a grace period (currently 7 days). If the amount is still unpaid after that, the organization is suspended until it is paid.
  • Usage is limited by the plan's quotas and spend limits. When a limit is reached, new scans may pause until the next period or until you add capacity.

8. Cancellation and refunds

You can cancel a subscription at any time in the billing settings. Cancelling stops the next renewal: the plan stays active until the end of the period you have paid for and then ends. Until then you can resume it.

Fees already paid are not refunded, and there are no partial refunds for the unused part of a period or for unused usage, except where the law requires a refund.

If you use Geovium as a consumer, your mandatory rights under consumer protection law are not affected.

9. Price changes

We may change our prices. We will tell the organization's admins by email at least 30 days before a new price applies to an existing subscription. The new price applies from the first renewal after that date. If you do not agree, you can cancel before the renewal.

10. Your data and the licence you give us

  • You keep all rights to the content you put into Geovium (brand terms, competitors, questions, settings) and to the data you import from integrations (together, “Customer Data”).
  • You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, process and transmit Customer Data, including sending it to the AI assistants and integrations you use, only as needed to provide, secure and support the service and as described in the Privacy Policy. The licence ends when the data is deleted.
  • You confirm that you have the rights and, where needed, the legal basis to give us Customer Data. Where Customer Data contains personal data, you are the controller, and we process it on your behalf and on your instructions as set out in these Terms.
  • AI answers are produced by third parties. We claim no ownership of them; your use of them is subject to the terms of the provider that produced them.
  • You can export Customer Data while the organization exists (see the Privacy Policy).

11. Third-party services

Geovium relies on third parties such as the AI providers, Stripe, Google and Shopify. Their services are governed by their own terms, and we are not responsible for their availability, accuracy or conduct. If your workspace uses its own AI provider API key, your agreement with that provider applies and that provider charges you for the usage.

12. Confidentiality

Each party keeps the non-public information it receives from the other in connection with the service confidential, uses it only for the purposes of these Terms, and shares it only with people who need it and are bound by similar duties. This does not apply to information that is or becomes public without a breach, was already known, is developed independently, or must be disclosed by law. These duties continue after these Terms end.

13. Intellectual property

Geovium, including its software, methodology, design and brand, belongs to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the service during your subscription and transfer no other rights. If you send us feedback, we may use it without any obligation to you.

14. Disclaimers

Except as expressly stated in these Terms, the service is provided “as is” and “as available”. To the extent the law allows, we give no warranties, express or implied, including of merchantability, fitness for a particular purpose, accuracy or uninterrupted availability.

15. Limitation of liability

To the extent the law allows: (a) neither party is liable for indirect or consequential loss, such as loss of profit, revenue, data or goodwill; and (b) each party's total liability arising from these Terms is limited to the fees the Customer paid for the service in the 12 months before the event that gave rise to the claim.

These limits do not apply to liability that the law does not allow to be limited, including liability for intent or gross negligence, or to the Customer's payment obligations.

16. Suspension, termination and deletion of data

  • You can stop using Geovium at any time by cancelling the subscription and deleting the accounts.
  • We may suspend or end access if you seriously or repeatedly breach these Terms or do not pay, or where needed to protect the service, other customers or third parties. Where reasonable, we will warn you first.
  • Deleting an account schedules its deletion for 30 days later, and you can cancel during that time. After 30 days the account is deleted. When the last user of an organization is deleted, the organization is permanently deleted with all its workspaces and data, and its customer record at Stripe is removed.
  • Export the data you need before deletion. Deleted data can remain in backups until they expire (at most 89 days).
  • Provisions that by their nature should continue (such as payment, confidentiality, intellectual property, liability and governing law) survive the end of these Terms.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul (Central) (İstanbul Merkez Mahkemeleri ve İcra Daireleri) have jurisdiction over disputes.

If you are a consumer, the mandatory rules of the law of your country of residence and your right to apply to consumer arbitration committees or consumer courts are not affected.

18. Changes to these Terms

We may update these Terms. We will announce material changes by email or in the application at least 30 days before they take effect. If you keep using Geovium after that date, the new Terms apply; if you do not agree, you can cancel before then.
